Frequently Asked Questions
For years, the European truck manufacturers DAF, DAIMLER/MERCEDES, IVECO, MAN, RENAULT, SCANIA and VOLVO made illegal price-fixing agreements – the so-called truck cartel. The European Commission imposed billions in fines on the companies involved.
You too very likely paid inflated prices for trucks bought between 2003 and 2011. You can now recover this money – easily, quickly, and without risk, with the German Service Center for Cartel Compensation (DeSeKa).
True – many companies have already tried to obtain compensation. But the proceedings were often lengthy and expensive, and for many of those affected they are still ongoing.
Today the situation is fundamentally different: courts have now ruled in favor of several truck buyers (for example the Berlin Regional Court on 15 June 2023 – 61 O 1/23 Kart), which makes the chances of success far easier to assess. This has opened up a new option: A litigation funder buys your claim and enforces it at its own risk. You receive your payout within 60 days – no need to wait for a court ruling. You keep the money in any case – even if the proceedings are later unsuccessful.
No. Whichever model you choose, a litigation funder bears the financial risk. With immediate compensation, you will receive your money within approximately 60 days, regardless of the subsequent outcome of the proceedings. With compensation after court proceedings, you have the chance of a higher payout. If successful, a success fee of 35% is deducted from the net proceeds after expenses. The litigation funder covers all costs – including lawyers' and court fees. You pay nothing up front.
orking with renowned commercial law firms and international litigation funders, we enable you to enforce your claims quickly and without risk – and with only a handful of documents. After our preliminary review, you receive a clear assessment of your claims, and a dedicated contact person is there for you throughout.
In 2024, the last EU antitrust proceedings – against Scania – were concluded with final and binding effect (judgment of the European Court of Justice of 1 February 2024 – C-251/22 P). This once again opens the door to compensation claims against all manufacturers involved. The statutory limitation period has been running since the Scania proceedings concluded. Affected truck buyers now have one last chance to obtain compensation for purchases made between 2003 and 2011 – even if they have taken no action so far. To ensure we can still take your claims into account, you must register by 31 October 2026.
